I got hit from behind this evening during rush hour. I was driving my TSX. I stopped at an intersection (75th St.) to make a right turn on to 59 near the Fox Valley Mall. I wait as other cars go by, then as I get ready to accelerate I get rammed by another motorist at over 10 mph. He tried to accelerate as well and hit me. The bumper of my TSX got scratched and my mufflers was damaged. Now I find that my TSX's bumper is pushed in a bit!

The Aurora police came and wrote up a report. On Saturday, I am going to get the damage appraised. I took pictures of my TSX and the '02 Oldsmobile Alero that hit me with a disposable camera I had in a storage compartment. We exchanged information. The Oldsmobile had a right side broken headlight, other than that his car had no damage, wtf!?!

I will get those pictures developed this weekend.

Well, as they say, at least you didn't get hurt (I assume). And it sounds like the TSX took it pretty well. A 10 MPH hit can do a lot worse than that.

Also sounds like this is a case where there won't be any question about who was at fault, and it won't be you.

The other driver was stunned and apologetic when he hit me. His State Farm insurance was legit. I hope nothing else happens and he says its my fault, which obviously isn't cuz he hit me!

I think the person saw me brake, but couldn't react quick enough and thought I was going to go. I don't see how he couldn't have saw me cuz my brake lights work fine and the lamp on the spoiler works fine.

Today, I called his insurance company to make a claim and took my car in to State Farm for damage inspection earlier tonight. The rear bumper needs to be replaced as well as rightside exhaust/muffler, and there are some "hidden" underbody damage you can't see unless you look under the car....over $1,500 worth of damage...argh!!!

Also, I don't trust State Farm's recommendation on repair shops. I heard they do really shietty job to keep claim costs low...those bastards! I don't want my TSX to have a wrong color bumper...argh!!! I am so upset!!!

I got mine repaired at 5 Star Auto Constructon in Dundee. I've had it fixed there for 2 different incidences and had another car fixed there and I would recommend them. They do work with State Farm.
Many many shops work with State Farm, it just depends on the shop whether they're good or not.

You don't have too much to worry about. When someone hits you in the rear, it's like he's at fault even if he wasn't -- meaning that it's such a universal principle that it was the fault of the person who hit you from behind that even when there are extenuating circumstances that make it not his fault, he'll have a hell of a time trying to prove it. And this situation doesn't even sound anywhere close to "extenuating circumstances."

It's not impossible that he or his insurance will try a little bit to avoid paying the whole thing, but it's seems pretty sure that when all is said and done, they will pay it, and without too much trouble. (Your insurance company will battle it out with them if they have to.) I had a similar situation a couple of years ago -- it wasn't from behind, so my situation wasn't as solid as yours, but it was quite clear that the other person was at fault. At first the other insurance company tried to say that I should be 33% responsible, because there was no "evidence that I had attempted to undertake avoidant action" or something like that. (BTW I absolutely did "attempt.") And from there on, I myself didn't have to do anything, it just got worked out. I got a couple of letters along the way from my insurance (which happens to be State Farm) telling me that they were working on it and that I would have to be prepared to participate in possible action on this. And then, within a few weeks, without anything else -- without any notification that the case had been resolved -- I got a couple of checks equal to the full amount that my repairs had cost, first a check for the whole amount except the deductible and then a check for the deductible.

I think that's probably the worst case scenario for you, since your situation seems like more of a slam-dunk than mine was -- because mine wasn't from behind.
